Meeting was called to Order by Chairman at 7:00 p.m. at the Milford Township Municipal Building and opened with the Pledge of Allegiance to the U.S. Flag.

Setting of Bond Limits - Mansfield made a motion to set the following bond amounts:
The Secretary-Treasurer be bonded for $2,000,000.
The Township Manager be bonded for $2,000,000.
The Finance Director be bonded for $2,000,000.
The Earned Income Tax Collector be bonded for $1,000,000.
Motion was seconded by Strunk and approved unanimously.
Resolution 2011-1, Establishment of Tax Rates for 2011
Mansfield made the following motion:
a. to set the Earned Income Tax rate at 1.75% Total (1% going to QCSD, 0.50% to Twp General Fund and 0.25% to Twp Open Space Acquisition Fund)
b. to set the Real Estate Transfer Tax at 1% (1/2 of 1% going to QCSD).
Motion was seconded by Strunk and passed unanimously
Mansfield made a motion to approve Resolution 2011-02 Levying a two mill Real Estate Tax and setting discount and penalty terms for its collection (0.75 mills for the General Fund and 1.25 mills for Fire Tax). Motion was seconded by Strunk and passed unanimously. See Addendum # 1.
Mansfield made a motion to approve Resolution 2011-03 2011, Street Light Assessments. Motion was seconded by Strunk and passed unanimously. See Addendum # 2

Certification of Delegate(s) to the 2011 PSATS Convention April 17-20, 2011 in Hershey PA and selection of the voting delegate.
Mansfield made a motion to appoint Timothy Damiani voting delegate to the PSATS Convention. Motion was seconded by Strunk and approved unanimously. Timothy Damiani plans to attend.
Annual Bucks County Assn. of Township Officials Convention, February 12, 2011 – No one plans to attend.

(a) Code Enforcement Office – During the month of December 2010, the following permits were issued: 1 single family dwelling; 6 residential renovation; 1 accessory building; 2 miscellaneous; 8 use and occupancy; and 1 zoning hearing application.
(b) Public Works - During the month of December 2010, the Public Works Department staff: 1) installed 9 new trail signs along Parkside Trail; 2) put up snowplow markers throughout the township; 3) went out to cinder one time and to plow one time; 4) removed large dead trees at Unami Creek Park and at Fernbrook Park; and 5) worked on removing invasive plants at Molasses Creek Park.
(c) Township Manager – Vey requested approval to enter into an agreement with Hough Associates ÒTo Collect 2010 Residential and Commercial Recycling Data and Prepare PA DEP 904 Recycling Grant Application for Milford TownshipÓ for $3,500. Strunk made a motion to enter into the agreement. Motion was seconded by Damiani and passed unanimously.

(b) Bridge inspection report – Walnut Lane and Doerr Road. Vey reported that both bridges received favorable review with minor work recommended.
Reports:
Township Manager – Mancini Metal –Storage at Route 663 & PA Turnpike. Mr. Mancini presented plans showing a pole building. Supervisors recognized that the removal of the existing building would improve appearance, but the plans failed to meet architectural control standards. Mr. Vey provided copies of design elements that could be incorporated. Damiani asked that Mr. Mancini contact the builder and find out what low cost options were available to comply.
Subdivision: LifeQuest, Lot H of Milford Village – Plans were distributed for future review.

Public Comments: Robert Flack, 2265 Mill Hill Road, complimented the Road Crew on a job well done on the roads during the recent inclement weather.

Approval of Minutes of Previous Meeting: Mansfield made a motion to approve the Minutes of the January 18, 2011 Regular Meeting. Motion was seconded by Damiani and passed unanimously. NOTE: The January 25, 2011 Work Session was cancelled. The February 1, 2011 Regular Meeting was cancelled due to inclement weather.
Approval of Invoices for Payment and TreasurerÕs Reports: Having reviewed the invoices and TreasurerÕs Reports, Strunk made a motion to approve the invoices for payment per 2-page list dated February 1, 2011 and the 2-page list dated February 15, 2011, as well as the December 31, 2010 TreasurerÕs Report (unaudited figures) and the January 31, 2011 TreasurerÕs Report. Motion was seconded by Mansfield and passed unanimously.

Reports:
(a) Code Enforcement – During the month of January 2011, the following permits were issued: 1 zoning time extension; 1 re-inspection fee; 1 residential renovation; 1 accessory structure; 5 use and occupancy; and 1 zoning hearing application.
(b) Public Works
1) During the month of January 2011, the Public Works Department (PWD) staff were kept very busy with snow removal having gone out 11 times to cinder and 4 times to plow with many hours spent plowing back drifts. The PWD staff removed the Bilger cabin along the Unami Creek at WonsidlerÕs Grove and took down 2 large dead trees (one along side the pavilion at Unami Creek Park and one at WonsidlerÕs Grove).
2) David Winkler requested approval to order the zero turn mowers and the skid steer on tracks in order to be ready for springtime (both will be purchased under the state contract). Mansfield made a motion to grant approval for the equipment purchase. Motion was seconded by Damiani and passed unanimously.
(c) Township Manager
1) Liquid Fuels Tax Fund Examination Report for Year ended December 31, 2009, Report was received January 14, 2011 from the PA Office of the Auditor General with no material deficiencies noted.
2) Sergeant Vincent K, DÕAngelo, Station Commander, Pennsylvania State Police, Troop M Dublin gave a status report on activities in the area and was available to answer questions.
3) Planning Services Agreement for QAPC, Mansfield made a motion to approve the agreement. Motion was seconded by Damiani and passed unanimously.
4) Mancini Architectural Controls – Mansfield made a motion to approve the architectural plan. Motion was seconded by Damiani and passed unanimously.
Subdivision/Land Development/Sewage Facilities:
Resolution 2011-07, Papiernik – TMP 23-2-60, Approval of Preliminary/Final Plans of Subdivision
Todd Myers, Cowan Associates, represented the Papierniks. The proposal is to subdivide a 1.2216-acre parcel, which contains an existing twin dwelling, into two single-family semi-detached dwelling lots and one open space lot. The proposed semi-detached lots would consist of Lot 1 (0.224-acre) and Lot 2 (0.3882-acre); the open space lot (0.6393-acre) would be dedicated to Milford Township. A lot line adjustment is also proposed to the adjacent land owned by Milford Township (TMP #23-3-68) to eliminate an existing driveway encroachment onto Township land. The lot line adjustment would consist of conveying 1,134.69 square feet from TMP #23-3-68 to proposed Lot 1. The existing dwellings are served by individual wells and public sewerage.
MOTION - Mansfield the motion to approve the Papiernik subdivision on the following conditions:
1. Prior to the recording of the Record Plans, all technical issues addressed in the Township EngineerÕs reviews dated November 10, 2010 shall be addressed to the satisfaction of the Township Engineer.
2. Prior to the recording of the Record Plans, the Plans shall be revised as follows:
A. Re-identify currently designated ÒLot 3Ó as ÒParcel AÓ which will be merged with the re-configured TMP 23-3-68;
B. Add the applicable Standard Notes from Appendix A and B of the Milford Township Subdivision and Land Development Ordinance (ÒSALDOÓ) to sheet 1; and
C. Delineate on the Plans the area for the Water Authority Easement for the water line located across the southern lot identified on the Plans as ÒLot 2Ó.
3. The Board of Supervisors approved waivers from the following provisions of the Milford Township Subdivision and Land Development Ordinance:
A. Section 514.b, requiring lot lines to intersect street at right angles;
B. Section 514.f, regarding lot width to depth ratio;
C. Section 519a and 608, requiring sidewalks along Spinnerstown Road and Valley View Road; and
D. Section 701.e.2, requiring the existing features within 400 feet of the site to be shown on the Plans.
4. Prior to the recording of the Record Plans, Owners of the Property will execute a Deed of Dedication to Milford Township prepared by the Township Solicitor for the ultimate right-of-way of Spinnerstown Road along the Property. Said conveyance shall be made free and clear of all liens such that title is marketable and insurable by a reputable title insurance company at ordinary rates. The Deed shall be recorded prior to or simultaneously with the recording of the Record Plans.
5. Prior to the recording of the Record Plans, Milford Township will execute a Deed of Conveyance for 1135 square feet of TMP 28-3-68 to the Owners of the Property prepared by the Township Solicitor as shown on the Plans. The Deed shall be recorded prior to or simultaneously with the recording of the Record Plans. Owners shall pay any and all transfer tax due resulting from the conveyance.
6. Prior to the recording of the Record Plans, Owners of the Property will execute a Deed of Dedication to Milford Township prepared by the Township Solicitor for the Open Space, currently shown on the Plans as ÒLot 3Ó, and to be re-identified as ÒParcel AÓ on the Plans. Said conveyance shall be made free and clear of all liens such that title is marketable and insurable by a reputable title insurance company at ordinary rates. The Deed shall be recorded prior to or simultaneously with the recording of the Record Plans. The Deed of Dedication for the Open Space is accepted by the Township in lieu of Owners completing full frontage improvements to Spinnerstown Road and in lieu of installing sidewalks on the Property.
7. Prior to the recording of the Record Plans, Township will execute a Deed of Consolidation prepared by the Township Solicitor merging the Open Space, currently shown on the Plans as ÒLot 3Ó, and to be re-identified as ÒParcel AÓ on the Plans with TMP No. 23-3-68. The Deed shall be recorded prior to or simultaneously with the recording of the Record Plans.
8. Prior to the recording of the Record Plans, you shall provide Township with the following written verification that the monuments have been installed or adequate financial security to assure their installation shall be deposited with the Township and an escrow agreement executed to assure their installation by a date certain.
10. All utilities extended to the lots in this subdivision whether within a public right-of-way or across the property shall be extended underground.
11. Prior to the recording of the record Plans, you will pay all costs incurred by the Township in the review of this application including legal, engineering and administrative costs.
12. At the time the Plans are submitted for recording, ten (10) paper copies, all duly executed IN BLACK INK by the proper persons or entities shall be supplied to the Township. The Record Plans shall show street names and numbers as designated by the Township. In addition, you will provide the Township in digital format all of the information contained on the Record Plans including street names and numbers. Please assure that the OwnerÕs block and Notary Acknowledgement show the correct owner(s) of record and that the Notary Public signs and seals (both stamp and embossed) all copies of the Plans.

MB Research – informal discussion Public sewer service
Angelika Forndran, P.E.,Director of Environmental Engineering from Cowan Associates, Inc represented MB Research. Ms. Forndran stated that MB is investigating alternatives to replace their aging spray irrigation system and would like to determine if connecting to the public sewer system of the MTASA is feasible. The reason for approaching the supervisors at this time is due to the fact that the Milford Township Sewage Facilities Plan (Act 537) shows the MB Research property as ÒCommunity SystemÓ and not in the public sewer service area.
Mr. Andersen provided Ms. Fordran with plans showing that a sewer easement exists along the property line on adjacent property owner by Prologis and having the Georgia Pacific warehouse. It would be MB ResearchÕs responsibility to contact the proper owner and to verify the existence of the sewer easement.
Mr. Vey stated that any resulting sewer connection should be done to enable connection of the BE Equipment property possibly to the extent of installing the small diameter PVC piping that would be required for the pressure line that would be necessary. Mr. Strunk stated that the Board had previously discussed the desirability of having both MB and BE connected to public sewer. Mr. Mansfield stated that he felt commercial and industrial users should be connected to public sewer. Mr. Damiani stated that the board appears to be favorably disposed to revise the townshipÕs Act 537 plan to permit this connection once MB Research has done its due diligence.
Macho – Request to Ratify Separate Deeds
Dennis Lawrence, realtor for Mrs. Macho, requested that the Supervisors ratify that separate deeds can be recorded for the Macho property. Susan Piette reviewed the situation as follows:
1. Although the property was conveyed to the Macho family in a single deed, Fels Road bisects the property.
2. Two separate tax map parcel numbers have been assigned to the property: 23-007-121 compromising approximately 19.51 acres and 23-007-032 compromising approximately 12.48 acres.
3. The property has been Ms. MachoÕs primary residence for the past 43 years and the entire property was in her husbandÕs family since the mid-1800s.
4. Fels Road effected the division of the property into two tracts.
5. Ms. Macho has been forced to leave the property because of health reasons.
6. Ms. Macho has conveyed the ultimate right-of-way of Fels Road to the Township, a condition which would be made of subdivision approval.
7. A survey has been completed and new legal descriptions have been prepared based upon that survey which could suffice for the purpose of conveying the two separate tax map parcels.
Although the Township is entitled to require subdivision approval where a tract of land is described in a single deed but later bisected by a road, the Board can determine that all conditions have previously been met and a hardship exists justifying waiver of the requirement of subdivision approval in this case.
MOTION - Mansfield made a motion to ratify the separate deeds based on the justification presented by the SolicitorÕs office. Strunk seconded the motion. The motion passed with Damiani abstaining from the vote.

(e) Public Works - During the month of February 2011, the Public Works Department (PWD) staff were once again kept very busy with snow and ice removal having gone out 8 times to cinder and 1 time to plow. The PWD staff continue to clean up tree branches along the roads from ice storms and high winds. Regent Tree Service assisted in taking down 2 large trees that were leaning over the roadway. The PWD staff are also out patching potholes throughout the township.

Subdivision:
Resolution 2011-08, Bimes – TMP 23-21-120-1, Approval of Preliminary/Final Plans of Subdivision
MOTION – Mansfield made a motion to grant preliminary/final approval of the Bimes plans subject to the following conditions:
1. Prior to the recording of the Record Plans, you will address all outstanding engineering issues identified in the December 27, 2010 letter of Andersen Engineering Associates, Inc., Township Engineer, to the satisfaction of the Board of Supervisors.
2. Prior to the recording of the Record Plans, the Plans will be revised by adding a note on the Plans that provides that a grading plan and a soil erosion control plan shall be required at the time an application is made for a building permit for the newly created building lot.
3. The Board of Supervisors approved a waiver from the following provisions of the Milford Township Subdivision and Land Development Ordinance:
A. Section 505, which requires cartway widening;
B. Section 516, which requires curb along existing roads;
C. Section 519, which requires sidewalks; and
D. Section 701.e, which requires the preparation of an Existing Resources and Site Analysis Plan.
4. The Board of Supervisors hereby grants a waiver from the Township Water Ordinance such that the existing dwelling shall not be required to be served by public water provided however, that if the existing well becomes inadequate, the Property shall be connected to public water supply rather than replacing the well with another on-site well.
5. Prior to the recording of the Record Plans, you shall provide the Township with the following:
a. satisfactory evidence that Developer has acquired an EDU from the Milford Township Water Authority authorizing connection of the new lot to public water service;
b. satisfactory evidence that Developer has acquired an EDU from the Milford Trumbauersville Area Sewer Authority authorizing connection of the new lot created by this subdivision to public sewer service.
c. satisfactory evidence that concrete monuments were installed or adequate financial security to assure their installation shall be deposited with the Township and an escrow agreement executed to assure their installation by a date certain.
6. Prior to the issuance of a building permit for the new building lot and in lieu of performing a traffic impact study for the subdivision, Developer shall contribute to Milford Township the sum of one thousand eight hundred and fifty ($1,850.00) dollars, which sum shall be deposited into the TownshipÕs Highway Capital Improvement Fund and will be used for capital improvements on roads in the Township.
7. Prior to the issuance of a building permit for the new building lot and in lieu of providing recreational improvements in the subdivision, Developer shall contribute to the Township the sum of one thousand, five hundred ($1,500.00) dollars.
8. The ultimate rights-of-way of Hillcrest and Freier Road were previously dedicated to the Township.
9. A zoning variance was granted by the Milford Township Zoning Hearing Board on November 9, 2010 to permit the existing barn on proposed lot 1 to encroach into the side yard of proposed adjoining lot 2.
10. Prior to the recording of the Record Plans, you will pay all costs incurred by the Township in the review of this application including engineering, legal and administrative costs.
11. At the time the Plans are submitted for recording, ten (10) paper copies, all duly executed in BLACK INK by the proper persons or entities, shall be supplied to the Township. The Record Plans shall show street names and numbers as designated by the Township. In addition, you will provide the Township in digital format all of the information contained on the Record Plans including street names and numbers. Please assure that the OwnerÕs block and Notary Acknowledgement show the correct owner(s) of record and that the Notary Public signs and seals (both stamp and embossed) all paper copies of the Plans.

Authorization to Purchase Trailer: Mansfield made a motion to authorize purchase of a trailer at the low quote of $5,700. Motion was seconded by Strunk and passed.
Authorization to Purchase Batwing Mower: Mansfield made a motion to authorize purchase of a Batwing Mower at the low quote of $15,018.08. Motion was seconded by Strunk and passed.
Spring Road Inspection:
The supervisors, manager and roadmaster conducted the Spring Road Inspection visiting the following locations: Quaker Pointe Road and Milford Square Pike (review of capital project and NPDES permit conditions), C & M development, Milford Pointe (review of incomplete public improvements and NPDES permit concerns), AcheyÕs Dam Removal, Blackledge (public improvements completion), Brookfield (pending subdivision), Clover Lane (cul-de-sac and surface conditions), Cassel Road (Òsnow fenceÓ review), Hieter Road – north end (drainage concerns), Totlow Road (guide rail), Old Plains at EstenÕs (potential drainage easement donation).

Minutes of April 5, 2011 Regular Meeting
Call to Order: Meeting was called to Order by Vice-Chairman at 7:03 p.m. at the Milford Township Municipal Building and opened with the Pledge of Allegiance to the U.S. Flag.
Supervisors Present: Robert B. Mansfield, Chairman, was available by phone for a portion of the meeting; Charles Strunk, Vice-Chairman; Timothy Damiani, Supervisor, was excused.

Approval of Minutes of Previous Meetings: Strunk made a motion to approve the Minutes of the March 1, 2011 Regular Meeting. Motion was seconded by Mansfield and passed. Note: The March 15, 2011 Regular Meeting was cancelled. The approval of the Minutes of the March 22, 2011 Work Session was deferred.
Approval of Invoices for Payment and TreasurerÕs Reports: Having reviewed the invoices and TreasurerÕs Report, Strunk made a motion to approve the invoices for payment per 2-page list dated April 5, 2011 and the March 31, 2011 TreasurerÕs Report. Motion was seconded by Mansfield and passed.

Reports:
(a) Park Board - The directional signs for the Parkside Trail and Fernbrook Trail and the entrance signs for Fernbrook and Kumry Road Trailhead are in. Exact locations for the signs need to be identified. Planning is taking place for painting and replacement of the plexiglass cover of the relocated Steinsburg Memorial, and to replace Disc Golf signage in Unami Creek Park due to reoriented layout. PaDEP permits for the Barrel Run Trail were received. The road crew will do this work as fill in between their projects. Members discussed the possibility of a pond with benches and plantings in Molasses Creek Park. The Park Board will be scheduling a day in May for clean up.
(b) Public Works – The Public Works (PW) staff spent most of March 2011working on the maintenance of equipment to be ready for the construction season. The PW staff along with Gerhart Electric installed ground lighting at the memorial flag in Molasses Creek Park. In addition, minor drainage work was completed at the 2310 Allentown Road barn (Shelly pole barn) and potholes were patched throughout the township. The PW staff were out 2 times to cinder during the month.
(c) Code Enforcement Office – During the month of March 2011, the following permits were issued: 5 residential accessory; 4 residential additions; 2 residential renovations; 1 commercial building; 2 commercial renovation; 1 industrial renovation; 9 use and occupancy; and 4 zoning hearing application.

Bucks County Board of Health West Nile Program
Mansfield made a motion to grant permission to the Bucks County Department of Health to allow the municipalÕs properties to be treated for mosquito control to help reduce the spread of West Nile Virus. The County requested this permission in their letter to the Township dated March 10, 2011. The motion was seconded by Strunk and passed.

Subdivisions:
(a) RESOLUTION 2011-09 -- LifeQuest/Milford Village Lot H, TMP 23-15-99, John Fries Highway (Rt. 663) -- Conditional Preliminary / Final Approval
MOTION – Strunk made a motion to approve the LifeQuest/Milford Village Lot H – Rt. 663 – Lot Line Change based on the following conditions to which Lifequest agreed to at the public meeting held on Tuesday, April 5, 2011:
Lot Line Change Plan for certain premises located on John Fries Highway (Rt. 663) in the Township identified as Lot H of Bucks County Tax Map Parcels No. 23-15-99 (the ÒPropertyÓ). The legal owner of the Property is Lifequest. The Plans of a Minor Subdivision Plan for the Property, prepared by Pany & Lentz Engineering Company, consisting of three (3) sheet, dated December 20, 2010 and last revised March 7, 2011, propose the subdivision of Lot H of TMP No. 23-15-99 into two (2) lots (the ÒPlansÓ). Lifequest Nursing Facility is located on Lot H-1 as shown on the Plans.
1. Prior to the recording of the Record Plans, you will address all outstanding engineering issues identified in the January 18, 2011 letter of Andersen Engineering Associates, Inc., Township Engineer, to the satisfaction of the Board of Supervisors.
2. The Board of Supervisors approved a waiver from the following provisions of the Milford Township Subdivision and Land Development Ordinance:
A. Section 505, which requires cartway widening;
B. Section 516, which requires curb along existing roads; and
C. Section 519, which requires sidewalks.
3. Prior to the recording of the Record Plans, the Plans shall be revised as follows:
A. the size of the Plans shall be revised to comply with the Recorder of Deeds maximum dimensions requirement of 24 inches x 36 inches;
B. Note 3. shall be revised stating substantially as follows:
ÒNo land development shall be approved for either Lot H-2 or H-2A in the subdivision, except as part of a subdivision or land development which is in compliance with the requirements of the Master Plan and Master Plan Declaration identified above. In addition, Lots H-2 and H-2A shall be incorporated into other properties within the Master Plan such that the resulting lots conform with the requirements of the Milford Township Zoning Ordinance and Subdivision and Land Development Ordinance.Ó
4. Prior to the recording of the Record Plans the owner of the Property shall execute a Deed of Dedication in a form prepared by the Township Solicitor, dedicating to Milford Township the area along John Fries Highway (Rt. 663) frontage of the Property with the ultimate right-of-way. At the time of the recording of the Record Plans, the area within the ultimate right-of-way shall be conveyed to Milford Township free and clear of all mortgages, liens or other encumbrances such that title is marketable and insurable by a reputable title insurance company at ordinary rates. The Deed shall be recorded prior to or simultaneously with the recording of the Record Plans.
5. Prior to the recording of the Record Plans, owners shall execute a Declaration of Covenants, Conditions and Restrictions in a form prepared by the Township Solicitor containing the provisions hereafter set forth. The Declaration shall be recorded prior to or simultaneously with the recording of the Record Plans. The Declaration shall contain the following provisions:
A. Lots H-1, H-2 and H-2A are subject to the provisions of the Declaration of Covenants, Conditions and Restrictions, including the Exhibits referenced therein and attached thereto (the ÒMaster Plan DeclarationÓ). The Master Plan Declaration is recorded in the Office of the Recorder of Deeds of Bucks County in Books 6592 at Page 577 and contains three Exhibits. All of the terms and provisions of the Master Plan Declaration and Exhibits thereto are binding on Lots H-1, H-2 and H-2A as though fully set forth at length in this Declaration; and
B. No land development shall be approved for either Lot H-2 or H-2A in the subdivision, except as part of a subdivision or land development which is in compliance with the requirements of the Master Plan and Master Plan Declaration identified above. In addition, Lots H-2 and H-2A shall be incorporated into other properties within the Master Plan such that the resulting lots conform with the requirements of the Milford Township Zoning Ordinance and Subdivision and Land Development Ordinance.
6. The owner of Lot H-1 shall have the obligation to maintain, repair, replace and remove snow and ice from this roadway extending from John Fries Highway (Rt. 663) to Lot H-1.
7. The private road within the subdivision shall be used solely for ingress and egress for the existing improvements on Lots H-1, H-2 and H-2A. It shall not be used for access to any other uses, lots or improvements until such time as its design has been approved as in compliance with the Milford Township Zoning Ordinance and Subdivision and Land Development Ordinance and has been improved to meet the design and construction requirements for private roadways in the Township Subdivision and Land Development Ordinance.
8. Prior to the recording of the Record Plans, you shall provide the Township with satisfactory evidence that concrete monuments were installed or adequate financial security to assure their installation shall be deposited with the Township and an escrow agreement executed to assure their installation by a date certain.
9. Prior to the recording of the Record Plans, you will pay all costs incurred by the Township in the review of this application including engineering, legal and administrative costs.
10. At the time the Plans are submitted for recording, ten (10) paper copies, all duly executed in BLACK INK by the proper persons or entities, shall be supplied to the Township. The Record Plans shall show street names and numbers as designated by the Township. In addition, you will provide the Township in digital format all of the information contained on the Record Plans including street names and numbers. Please assure that the OwnerÕs block and Notary Acknowledgement show the correct owner(s) of record and that the Notary Public signs and seals (both stamp and embossed) all paper copies of the Plans.

(b) RESOLUTION 2011-10 -- Milford Convenience, TMP Nos. 23-10-100-1 and 23-10-101, Weiss Road & Rt. 663 -- Conditional Preliminary / Final Approval
MOTION – Mansfield made a motion to grant preliminary/final approval of the Milford Convenience plans subject to the following conditions to which Milford Convenience agreed to at the meeting on Tuesday, April 5, 2011:
Lot Line Change Plan for certain premises located on Weiss Road and Route 663 in the Township identified as Bucks County Tax Map Parcels Nos. 23-10-100-1 and 23-10-101 (the ÒPropertyÓ). The legal owners of the Property are Milford Convenience LP. The Plans of a Lot Line Change for the Property, prepared by Ludgate Engineering Corporation, consisting of one (1) sheet, dated December 7, 2010, last revised January 4, 2011 propose the conveyance of 1.7 acres of TMP No. 23-10-101 to TMP No. 23-10-100-1 to be merged and consolidated with TMP No. 23-10-100-1 (the ÒPlansÓ).
1. Prior to the recording of the Record Plans, you will address all outstanding engineering issues identified in the January 12, 2011 and April 4, 2011 letters of Andersen Engineering Associates, Inc., Township Engineer, to the satisfaction of the Board of Supervisors.
2. The Board of Supervisors approved a waiver from the following provisions of the Milford Township Subdivision and Land Development Ordinance:
A. Section 505, which requires cartway widening;
B. Section 516, which requires curb along existing roads; and
C. Section 519, which requires sidewalks.
3. The Deed shall be recorded prior to or simultaneously with the recording of the Record Plans.
5. Prior to the Recording of the Record Plans, Milford Convenience LP shall execute a Deed of Dedication, in a form prepared by the Township Solicitor, dedicating to Milford Township the area along Weiss Road frontage of the Property within the ultimate right-of-way. At the time of the recording of the Record Plans, said conveyance shall be made free and clear of all mortgages, liens or other encumbrances such that title is marketable and insurable by a reputable title insurance company at ordinary rates. The Deed shall be recorded prior to or simultaneously with the recording of the Record Plans.
6. In consideration of the Township approving the waivers granted in paragraph 2, Developer agrees that in connection with any future subdivision and/or land development of Lot 1, Developer shall deposit financial security in the form of an Irrevocable Letter of Credit sufficient to secure construction of frontage improvements along Weiss Road on Lots 1 and 2 and construct those improvements at the time Lot 1 is developed. The current estimate of the cost of constructing frontage improvements to Weiss Road along Lots 1 and 2 is $57,120.00. This amount shall be increased each year based upon any increase in construction costs as determined by the Township Engineer.
7. Applicant has requested Township approval to extend public sewer to service the existing improvements on Lot 2 because the existing on-lot sewage disposal facilities are inadequate. Subject to the conditions herein, Township agrees to approve the repair of the malfunctioning sewage disposal system on Lot 2 by means of extending public sewer to the Property. The condition of such extension is that the owner of Lot 2 shall not request that any lots created by any future subdivision of Lot 2 be served by public sewer unless and until such time as the Board of Supervisors of Milford Township has adopted an amendment to the TownshipÕs Act 537 Plan which places Lot 2 together with other lots or tracts of land to the north of Lot 2 within its development district and which provides that the properties within that development district will be served by public sewer.
8. A Declaration of Covenants, Conditions and Restrictions shall be recorded at the time of the recording of the Record Plans stating substantially as follows:
ÒLot 2 shall not be subdivided to create any additional lots to be served by public sewer unless and until the Milford Township Board of Supervisors has approved an amendment to its Act 537 Plan placing Lot 2 and other properties to the north of Lot 2 in its development district and which provides that properties within that district will be served by public sewer.
9. Prior to the recording of the Record Plans you will provide satisfactory evidence that you have acquired an EDU for lot 2 from the Milford Trumbauersville Area Sewer Authority and connected Lot 2 to the Milford Trumbauersville Area Sewer Authority sewage system.
10. Prior to the recording of the Record Plans, you shall provide the Township with satisfactory evidence that concrete monuments were installed or adequate financial security to assure their installation shall be deposited with the Township and an escrow agreement executed to assure their installation by a date certain.
11. The ultimate right-of-way of John Fries Highway was previously dedicated to the Township.
12. Prior to the recording of the Record Plans, you will pay all costs incurred by the Township in the review of this application including engineering, legal and administrative costs.
13. At the time the Plans are submitted for recording, ten (10) paper copies, all duly executed in BLACK INK by the proper persons or entities, shall be supplied to the Township. The Record Plans shall show street names and numbers as designated by the Township. In addition, you will provide the Township in digital format all of the information contained on the Record Plans including street names and numbers. (c) RESOLUTION 2011-11 -- Richards, TMP 23-15-58, 2151 Brick Tavern Road --Final Minor Subdivision Approval
MOTION – Strunk made a motion to grant preliminary/final approval of the Richards plans subject to the following conditions:
Final Plans of Subdivision for premises consisting of 19.044 acres located at 2151 Brick Tavern Road in Milford Township and identified as Tax Map Parcel No. 23-15-58 (the ÒPropertyÓ). The legal owner of Tax Map Parcel No. 23-15-58 is Roxie Richards. Final Plans of Subdivision for the Property, prepared by Gilmore & Associates, Inc. consist of eight (8) sheets dated December 14, 2010, and were last revised on March 4, 2011 (the ÒPlansÓ). The Plans propose Subdivision of the Property into two lots. Lot 1 currently contains a non-conforming agricultural retail use and a non-conforming greenhouse. Lot 2 is a new building lot.
1. Prior to the recording of the record Plans, you will address any remaining technical issues remaining from the Township EngineerÕs review dated December 27, 2010 and March 15, 2011, and all subsequent reviews to the satisfaction of the Township Engineer.
2. The Board of Supervisors approved a waiver from the following provisions of the Milford Township Subdivision and Land Development Ordinance:
a. Sections 505, 516 and 609 requiring roadway improvements and curbs along Brick Tavern Road, however, the Township is requiring a fee in lieu of said improvements as set forth in paragraph 7 of this letter;
b. Section 519 and 608 requiring sidewalks along Brick Tavern Road, however, the Township is requiring a fee in lieu of said improvements as set forth in paragraph 7 of this letter;
c. Section 606 requiring streetlights along Brick Tavern Road;
d. Section 703a requiring the submission of 24Ó x 36Ó plans;
e. Section 703d requiring a tree protection zone;
f. Section 701 requiring an aerial photograph depicting surrounding features; and
g. Section 703 and 701 requiring depiction of certain trees with a caliper in excess of 15 inches.
Prior to the recording of the Record Plans, the above waivers shall be placed on the Plans.
3. Prior to the recording of the Record Plans, the then owner shall execute a Deed of Dedication, in a form prepared by the Township Solicitor, dedicating to Milford Township (the ÒTownshipÓ) the area along Brick Tavern Road frontage of the Property within the ultimate right-of-way. At the time of the recording of the Record Plans, said conveyance shall be made free and clear of all mortgages, liens or other encumbrances such that title is marketable and insurable by a reputable title insurance company at ordinary rates. Additionally, at the time the Deed is recorded, Owner shall provide satisfactory evidence that the said property continues to be free and clear of mortgages, liens and encumbrances. The Deed shall be recorded prior to or simultaneously with the recording of the Record Plans.
4. Prior to the recording of the record Plans, owner will execute a Declaration of Covenants, Conditions, Easements and Restrictions, in a form prepared by the Township Solicitor, imposing:
a. a conservation easement on lot 1 and 2 of the Property providing for such terms and conditions to protect the natural resources on those lots and for other conservation purposes for the benefit of the Township;
b. an alternate sewage disposal area easement for lots 1 and 2 and protection from disturbance of the absorption site during construction; and
c. the obligation to maintain the stormwater drainage facilities on lots 1 and 2 and prohibiting any plantings or construction of structures within the easement area other than as shown on the Plans and granting a Stormwater Drainage Easement to Milford Township to access and restore the stormwater drainage facilities in the event the Declarant fails to perform the required obligations.
5. Prior to the issuance of a building permit and in lieu of providing recreational improvements in the subdivision, Developer will contribute to the Township the sum of One Thousand, Five Hundred ($1,500.00) Dollars.
6. Prior to the issuance of a building permit and in lieu of performing a traffic impact study for the subdivision, Developer will contribute to the Township the sum of One Thousand Eight Hundred Fifty ($1,850.00) Dollars, which sum shall be deposited into the TownshipÕs Highway Capital Improvement Fund and will be used for capital improvements on roads in the Township.
7. Prior to the issuance of a building permit and in lieu of full frontage improvements to the Property, Developer will contribute to the Township the sum of Eight Thousand Dollars ($8,000.00).
8. Prior to the recording of the Record Plans, Developer shall provide the Township with the following:
a. satisfactory evidence to the Township from the Bucks County Conservation District (the ÒBCCDÓ) approving the Plans for all areas within its jurisdiction, including without limitation the proposed temporary erosion and sedimentation control measures to be used during construction. The Plans shall be revised to include any requirements of the BCCD to the satisfaction of the Board of Supervisors and the Township Engineer;
b. satisfactory evidence to the Township that an NPDES permit has been issued for this Property; and
c. satisfactory evidence that the Bucks County Board of Health has approved the planning modules for this subdivision.
9. Prior to the recording of the Record Plans, Owner shall complete the improvements of the subdivision to the satisfaction of the Township Engineer or shall enter into a Land Development and Financial Security Agreement with the Township, prepared by the Township Solicitor and deposit adequate financial security in the form of a cash escrow or an Irrevocable Letter of Credit approved by the Township Solicitor from a bank or other approved financial institution for the construction of all those improvements to be located within Milford Township and having a public impact, including storm water drainage improvements, sedimentation and erosion control measures, grading, monuments and any other improvements required by the subdivision. The Letter of Credit shall include an Evergreen Clause to prevent expiration of the Letter of Credit. The Township shall not release financial security until both the dedicated and non-dedicated improvements are completed.
10. A concrete monument shall be installed at the intersection of the lot lines for the southeast corner of Lot 1. If the monuments are not installed prior to the recording of the record Plans, adequate financial security shall be posted to assure their installation.
11. All utilities extended to the lots in this subdivision whether within a public right-of-way or across the property shall be extended underground.
12. Prior to the recording of the Record Plans, you will pay all costs incurred by the Township in the review of this application including engineering, legal and administrative costs.
13. At the time the Plans are submitted for recording, ten (10) paper copies, all duly executed by the proper persons or entities, shall be supplied to the Township. The Record Plans shall show street names and numbers as designated by the Township. (d) RESOLUTION 2011-12 -- Reserve at Milford Planning Module
The Act 537 Planning Module for the previously approved subdivision called Reserve at Milford (WB Homes) was submitted for approval to connect to the public sewer involving 31 dwellings.
Upon motion of Mansfield and second by Strunk, the Planning Module was unanimously approved.
Escrow Release:
(a) RESOLUTION 2011-13 -- Blackledge, Release Bond Requirement and Accept Cash Escrow Balance in lieu of Replacement of Trees
MOTION – Mansfield made a motion to release the bond requirement (currently valued at $162,484.95) and to accept the release by Blackledge of their 18-Month L&E cash escrow balance of $1,103.47 to the General Fund in lieu of the replacement of trees.
The motion was seconded by Strunk and passed.
Public Comments: Thomas Souders, a member of the Trumbauersville Fire Company, asked to use the area across from the Township Building for setting up luminaries as well as other displays for the tenth anniversary of 11 September 2001. No motion by the Board, as this request will be presented to the Park Board for consideration.

Presentation:
Upper Perkiomen Valley Chamber of Commerce – Luanne B. Stauffer, President, presented an update on PerkUpÕs three (3) initiatives: 1) Outdoor Recreation and Nature Tourism;
2) Professional, Technical, Scientific Services (Business Development Council); and 3) Educational Partnerships. She also addressed other UPVCC endeavors in her presentation.

(a) Vey requested Board authorization to advertise a public hearing to approve tax exempt financing of new tanker – Mansfield made a motion, seconded by Strunk and passed.
(b) Traffic Services – Mansfield made a motion to accept the proposal from Traffic Planning and Design, Inc. for ÒTraffic Study and Highway Occupancy Permit Design ServicesÓ regarding the HOP application associated with the C & M Homes project, at an estimated cost of $9,150. Motion was seconded by Strunk and passed.
Subdivisions:
(e) Wally Smerconish – Mr. Smerconish presented plans for property on Trumbauersville Road (23-21-43). This property received subdivision approval for 9 single family homes. The concept plan proposes a change of zoning to SRL to permit 52 townhouses. Mr. Smerconish showed other similar developments he has built and suggested that this form of development would be appropriate for the site since it is adjacent to Trumbauersville Borough and would promote walking to local businesses.
Mr. Mansfield said he had concern of what impact such a development would have on the schools. Mr. Smerconish offered to supply school impact information. Mr. Mansfield said that the board would receive and evaluate any information supplied, but that he was not favorably disposed to changing the zoning to encourage greater density than you now find in the adjacent borough.
Public Comments:
Scott Hendricks, Starr Road, asked why the township is not moving to fill the vacancy of Tim Damiani who suffered a stroke. Mr.Mansfield responded that the position is not vacant and that he felt it inappropriate for Milford to seek Mr. DamianiÕs removal as he is recovering. Mr. Hendricks asked if the Milford was paying for the new tanker. Vey responded ÒnoÓ, and explained that IRS regulations (IRC Sec 147 f) required the BoardsÕ approval for the fire company to qualify for tax exempt financing.
Nancy Gill, Allentown Road, asked about the status of the disc golf course in Unami Creek Park. Mansfield responded that for now the course is staying. She inquired about the number of members on the Park Board. Vey named the five people on the board. Mr. Mansfield stated that the park ordinance is being redrafted to reduce the number of members on the board from 7 to 5.
Chris Tray, Willow Stream Drive, inquired about word of a new pond planned for installation in Molasses Creek Park for $65,000. Vey responded the Park Board discussed a pond and he had Bob Irick (Park Board Chairman) forward the concept plan. Mr. Mansfield stated this is not a Milford Capital project and the board intends to monitor discussions.

Park Board Report:
The Molasses Creek walking path needs to have a new layer of limestone put down.
Ed will coordinate painting and replacement of Plexiglas cover of the relocated Steinsburg Memorial with an interested resident and members of the Park Board.
May 15 has been scheduled for Park clean up day. The Park Board would like to invite all interested residents to join us at 1 PM at Molasses Creek Park as we clean trash from Township Parks and open spaces.
Wayne Taylor from Clover Mill Rd discussed the possibility of having an additional use for the tennis courts in that development. He would like to use the Court as a basketball court putting in a removable hoop. Park Board asked Mr. Taylor discuss this with the residents around the tennis court and next month Discuss this further with board.
Public Works Report:
The public works department began the month patching potholes and cleaning ditches with the gradall.
We removed the salt spreaders and snow plows from the trucks and put them in storage.
We did road repair on Fels Road near Doerr Road where the road was coming apart.
The road crew along with Asphalt Maintenance Solutions started skin patching throughout the township.
Code Enforcement Report:

Township Manager:
(a) Vey requested Board authorization for Terry Clemons to attend the Zoning Hearing meeting scheduled for May 10th to make certain access to Rt. 663 will be restricted to right-in and right-out only for the Krevitz case and that there will becompliance to Zoning Hearing conditions for the Butler Valley Farms case. Robert Mansfield made a motion to authorize Terry Clemons to attend, motion 2nd by Charles Strunk.
(b) Vey and Andersen discussed considerations that were raised in a recent meeting with PennDOT and the developer concerning improvements that will be required for future phases of Milford Village on Rt. 663 at Portzer. Traffic projections were revised to reflect the purchase of a portion of the site by St. LukeÕs Hospital that will result in building a hospital and related medical facilities. Items discussed were as follows.
1. PennDOT is not in favor of deferring Route 663/Portzer Road improvements to Phase Three, but it may be possible to defer widening along the frontage if intersection improvements are done earlier.
2. The projected delays to northbound Portzer Road at Route 663 in the ultimate signal design proposed for the intersection are not paramount because the volume is low and reducing the delay for that leg would adversely affect the flow on the arterial highway.
3. PennDOT requested that the Route 663/Portzer Road be analyzed with the Portzer Road improvements in place before the widening on Route 663 at the intersection.
4. PennDOT indicated that, in the best case, the roundabout at Portzer Road and Old Bethlehem Pike will begin construction in 2015. There is still right of way acquisition needed, wetland mitigation required. The engineering is funded and has been awarded to Dewberry. They believe that funding for construction will be in place for 2015 construction. If traffic warrants it, the intersection could be converted to 4-way stop control for safety, until the roundabout can be constructed.
5. PennDOT indicated that they are not concerned about the improvements at Route 663/Portzer Road necessarily being completed prior to the roundabout, rather the improvements are tied to the traffic added to the roadway system.
6. Milford Township and Del Markward want to construct the signal at Route 663 and Commerce Drive as soon as possible even if warrants are not yet quite satisfied. The relocation of Mill Hill Road will be the second improvement to be constructed after the improvements at Commerce. The warrants are not satisfied in part because the Commerce right turns are excluded. PennDOT indicated that the right turns are now sometimes allowed to be considered on a case by case basis, but the decision lies with Ashwin Patel, the District 6-0 Assistant District Traffic Engineer for Signals, Safety and Mobility. Temporarily striping out the right turn lane was cited as a possible way to include the right turning vehicles to satisfy the warrant.
7. PennDOT met with Richland Township about 3 years ago regarding Route 663/Old Bethlehem Pike. PennDOT indicated then and reiterated that PennDOT will never allow the intersection to be signalized due to the close spacing with the adjacent signalized intersection. They are in favor of restricting access at the intersection and rerouting traffic onto Portzer Road. A left from Route 663 into Old Bethlehem Pike may be possible, but definitely would restrict the left out of Old Bethlehem Pike onto Route 663.
8. Fran Hanney indicated that the only improvements he would ask for from Milford Village Center at the Route 663/Old Bethlehem Pike intersection would be signs and possibly some concrete to enlarge an island. Both Townships would have to agree to the restricted access.
9. Richland Township indicated that they were interested in a signal at Route 663/Old Bethlehem Pike, but now with the alternative of the signal at Portzer Road/Route 663 they do not know if opinions have changed. They had also considered moving Old Bethlehem Pike to the west side of the gas station to improve the angle and increase distance from the adjacent signal. The Township has not addressed the intersection further since the meeting with PennDOT. The opinion was expressed that habits may change to use Portzer and restricting Old Bethlehem access might not be an issue because people would already effectively be doing it..
10. PennDOT said they would still like to have the access restricted for safety. The study should continue to assume that Route 663/Old Bethlehem Pike will be right-in-right-out.
11. The tentative schedule for St. LukeÕs is 3 years to get funding, and 3-6 years to build, which puts construction in the 2014-2017 range.
12. Private bid and work does not require prevailing wages.
13. PennDOT indicated that they are not requiring all Route 663 improvements to be constructed at one time, but at the end of the project they want a final product that has consistency from end to end. PennDOT stated that Lifequest will not be doing any widening on Route 663 between the end of the Portzer Road improvements and Route 309.
14. Benchmark Engineering will prepare a letter report to PennDOT to work out the final details prior to resubmitting a revised TIS.
Vey noted to the Supervisors that each Phase of the Milford Village land development will have to be approved as a conditional use by Milford Township and the master plan must be revised showing that the overall site constraints are met. The highway improvement plan will be formally presented at that time for review.
(c) Vey reported that he and Dave Winkler, Public Works Director, met with Eric Wightman and Gretchen Schafschneider of the Bucks County Conservation District in the field to determine what improvements are needed and permitted for the C&M Milford Pointe site. It was determined that the NPDES permit for the site is still valid until August of this year. The work that is intended is limited grading and revegetation to the east of the basin next to Rosenberger Road, a 2 ft. shoulder widening of Starr and Rosenberger Roads with establishment of adjacent drainage swale, the installation and replacement of cross pipes at the intersection of Rosenberger and Starr Roads and paving to the wearing surface of only the roads serving the three houses built. The trail shown on the plan will be revised and permitted separately. He asked if the Supervisors concurred with the extent of intended improvements. Mansfield and Strunk concurred.

Presentation:
Milford Township Park Board – Bob Irick and the entire park board were in attendance and gave a presentation of plans and photographs of the trail system and parks. Through the course of the presentation, several recommendations were made:
1. Re-route the planned macadam path within the Milford Point development to connect to Milford Square Pike in the vicinity of Clover Mill Road. This would allow a greater number of residents access to the path.
2. Investigation of greater public access to the pond on the MTASA property on Rosenberger Road. It was suggested that a footpath looping the pond could eventually connect to the existing Unami Trail at Parkside.
3. Complete the missing links in the Barrel Run Trail. One link would be a connection from the Unami Trail at Allentown Road near Sycamore Drive to the existing portion of the Barrel Run Trail at Creamery Road below the Habitat For Humanity project (Emerald Lane). The other would be the planned (and permitted) link between Habitat for Humanity and Trumbauersville Elementary. Completion of this link before the start of school in the fall would allow a large number of kids to walk to school.
4. Complete the missing link of the Unami Trail at the limits of StreamView to Unami Creek Park. This would need to be accomplished over either lands of Phil Stein & Judy Szela or lands of Milford Builders.
5. Provide a macadam path bypassing the sidewalk portion of the Unami Trail currently in place.

He would like to see a removeable basketball hoop be placed in the court so that the residents could shot hoops. Board is ok with this use, staff will check on pricing for the removeable hoop and coordinate with Dave Winkler to fix the tennis court.

á Dear Members of the Board:

You have requested our opinion concerning whether a supervisor is permitted to participate in a public meeting via telephone.
Township Board Supervisor Tim DamianiÕs stroke and extended rehabilitation have resulted in occasions when a second Township Board Supervisor is unable to physically attend a public board meeting. As a result a Supervisor, on occasion, has participated in Board of Supervisors meetings remotely by use of speaker telephone. The Board has requested our opinion as to the legality of this practice and specifically of the legality of taking official Township action under these circumstances.
It is our opinion that if a Supervisor is unable to attend a public meeting physically he can participate in the meeting by speaker telephone, provided that the absent member is able to hear the comments of and speak to all those present at the meeting. In addition those present at the meeting must be able to hear the comments of and speak to the absent member contemporaneously. Under these circumstances the SupervisorÕs participation is legal and is as valid as if he were physically present at the public meeting.
Our opinion is based on the Sunshine Act (65 Pa. C.S. section 701 et seq.) and case law interpreting the Sunshine Act The purpose of the Sunshine Act is to ensure that official action and deliberations by a quorum of the members of an agency take place at a meeting open to the public. The Township Board of Supervisors is a “board of a political subdivision” making it an “agency” as defined by the Sunshine Act (65 Pa. C.S. section 703). The term “meeting” is defined in the Sunshine Act as “any prearranged gathering of an agency which is attended or participated in by a quorum of the members of an agency held for the purpose of deliberating agency business or taking official action” (65 Pa. C.S. section 703).
Case law provides that “participation” of members of agency boards by a telephone conference call using a speaker telephone in a meeting open to the public is acceptable provided that the absent member is able to hear the comments of and speak to all those present at the meeting and all those present at the meeting are able to hear the comments of and speak to such absent members contemporaneously. Babac v. PA Milk Marketing Board, 531 PA. 391; 613 A.2d 551 (1992), which remains valid case law.
The Sunshine Act gives the public the right to be present to personally observe the deliberation, policy formation and decision making of the agencies. It does not mandate that board members be physically present at such meetings. Allowing board members to participate by speaker telephone in no way infringes on this right. Therefore we conclude that participation by a Supervisor in a public Township Board of Supervisors meeting via speaker telephone is permitted provided that the communication conditions as set forth above are present.

The public works department began the month doing the annual spring street sweeping.
AMS completed 60,000 sq yards of oil and chip on Doerr Road, Rosenberger Road, Weiss Road, West Swamp Road, Myers Road, Stoudt Road and Brinkman Road.
We paved the entrance at Fernbrook Park.
We finished the well at Wonsidlers.
Also replaced three cross pipes on Keiser Road, Umbreit Road and Old Plains Road.
We completed the Old Plains road project from last year by planting evergreen trees from our nursery stock along the Fino property.
Code Enforcement - During April 2011, the following permits were issued: 7 accessory structure; 4 Residential Alterations and 11 Use & Occupancy.

Minutes of July 5, 2011 Regular Meeting
Call to Order: Meeting was called to Order by Chairman at 7:00 p.m. at the Milford Township Municipal Building and opened with the Pledge of Allegiance to the U.S. Flag.
Supervisors Present: Robert B. Mansfield, Chairman; Charles Strunk, Vice-Chairman; Timothy Damiani, Supervisor, was excused.

Approval of Minutes of Previous Meetings: Mansfield made a motion to approve the Minutes of the June 21, 2011 regular Meeting. Motion was seconded by Strunk and passed.
Approval of Invoices for Payment: Having reviewed the invoices, Strunk made a motion to approve the invoices for payment. Motion was seconded by Mansfield and passed.
Conditional Use: WAWa
The hearing was opened by Terry Clemons. who explained the conditional use process and asked if people wanted to have party status (no one indicated desire to become parties). Wawa is seeking to amend an approval from 2003 to allow diesel fuel to be dispensed. They indicated the pumps closest to Weiss Road would be used for diesel and that the intended customers are not tractor trailers, but rather cars and small trucks. A 15,000-gallon tank would need to be installed.
There was considerable discussion of how large commercial vehicles that have more impact (turning radius and noise) would be controlled from using the diesel pumps. WaWa testified that they would not accept ComCheck or other credit payments typical to the trucking industry. In addition, the nozzles would not be the large truck nozzles and the dispensing rate would be slow. Supervisors asked that WaWa bring back more details on the height clearance of the canopies and proposed signage before concluding the hearing. The conditional use hearing is continued to August 2, 2011.

Public Works:
The public works department began the month doing base repairs and paving on Hieter Road.
We started laying pipe on the New road project, we installed two inlet boxes and 70 feet of 15"RCP, 75Õ of 29x45 elliptical and 2 large headwalls.
Regent tree service came in and completed our weed spraying along curbs and guide rails also areas that have Japanese Knotweed.
Code Enforcement - During June 2011, the following permits were issued: 19 accessory structure; 6 Residential Alterations and 9 Use & Occupancy and 1 single family dwelling.
Plannning Commission - Minutes for the month of June are available for review.
Community Baptist Church
The Andersen Engineering (May 24, 2011 and the Bucks County Planning Commission (June 6, 2011) was reviewed. The applicant agreed to modify the plans to comply with the BCPC comments, most notably to decrease the size of the building to less than 30,000 square feet to comply with the variance granted by the Zoning Hearing Board. There was discussion regarding the possible reduction of depth of the parking spaces from 20 feet to 18 feet whenever the front of the space was up against Ògreen areaÓ and a request by the applicant to delay the application of final wearing surface for 18 months to allow the gas main company to inspect their facilities. The plan must be modified to provide open space in the form of a conservation easement and to change the species of trees to eliminate some troublesome species of trees. Finally, there was discussion regarding the 9 wavers requested by the applicant.
It should be noted that access to the site is via a driveway to Baus Road. The proposed intersection of the driveway and Baus Road is located in Lower Milford Township, Lehigh County. Supervisors requested more information on the driveway and asked that the applicant provide documentation that Lower Milford has approved the access.
Community Baptist requested this be tabled until August 2, 2011

Park cleanup was held on July 9th by members of Park Board. Roadway frontages of open spaces on Kumry/Klines Mill, Fels/Doerr and Fernbrook Park/Finland were cleared of approximately 15 bags of trash.

Park Board walked Fernbrook Trail and made several recommendations:
1. Several benches – near parking overlooking Unami Creek, along trail overlooking Unami Creek, and by ÒLilly PondÓ overlooking pond
2. Paint permanent swatches on trees along trail to replace flaggings
3. Formulate a mowing schedule – regular mowing on pavilion side of small stream, 8Õ wide path along trail, 15-20Õ wide swath along pond, and annual mowing in other grassed areas to maintain meadow condition
4. Provide grill
5. Create canoe/kayak launching area
Managers Report:
Baruffi – ZHB granted a variance to allow a pool to remain in the rear yard within the buffer yard at 2525 Cedarfield Ln. if the Supervisors waive buffer restrictions. Strunk moved to waive buffer with favorable solicitorÕs review and backwash discharge that doesnÕt adversely affect neighbors, Mansfield second and passed.
Precision Solutions requested partial refund of zoning hearing fees ($1,600). The case was withdrawn without hearing. Strunk moved to refund $1200.00, Mansfield seconded and passed.

Minutes of July 26, 2011 Work Session
Call to Order: Meeting was called to Order by Chairman at 5:38 p.m.

Review of Audit: Pat Roeder reviewed the Management Discussion and Analysis of the 2010 Audit (available on-line) to provide background of the townshipÕs financial position well in advance of budget preparation. The ensuing discussion made the following observations.
With development activity at a near standstill, there are few contributions to the traffic, recreation and open space maintenance fund as was anticipated in the budget. Milford continues to make capital expenditures in highway projects and that reduces the traffic fund. Mansfield noted that these restricted use funds should be utilized first before tapping general revenues, but we must monitor reserves.
Strunk noted that we are continuing our equipment replacement with purchase of a new International Dump truck and sale of the 16 year old International as well as a pick up truck replacement and acquisition of a Halla Excavator through the federal surplus program. There was discussion of accounting for depreciation and the general depreciation schedule.
One hundred and seventeen acres of open space were added in 2010. There was discussion of the maintenance required and only using interest from the Open Space Maintenance Fund (so the fund is not depleted) with the remainder from General Fund.
There was discussion about the state-mandated change in Earned Income Tax collection and potential impacts if residentsÕ withholding is misdirected to other jurisdictions. The Supervisors felt this may be a good issue for the August work session.
Strunk asked that there be a review of the terms of the cell tower lease, the light fund charges for C&M and the Wonsidler rents.
It was noted that the township is in good financial shape by controlling expenses, not over anticipating revenues, and properly using reserve funds.
Milford-Trumbauersville Sewer Authority: Joe Valentine, MTASA Board member, reported that there has been no development activity. He stated that the MTASA Board was asked if the pond on the AuthorityÕs property could be used for recreational use. While the board has no initial objection, they have concern about liability and the impact of parking. Theses issue will be further investigated.

Quakertown Airport Fuel Tanks
John Minninger made Presentation – this is a replacement and removal of an underground fuel tank that has been there since 1987-1988 it would be replaced with an above ground 10,000-gallon tank with bollards around it. It is self contained- has 24 hour service – credit card dispenser.

Public Works:
The public works department put down 2" of new white sand on the upper trail at Molasses Creek Park and mulched all landscaping in the park.
Reid paving came in and finished paving tie in at new road and Quaker Point also overlaid Quaker Point drive and C&M development.
The road crew has been working on roadway improvements at Starr and Rosenberger Roads along with the clean up from Hurricane Irene.
Code Enforcement
During July 2011, the following permits were issued: 6 accessory structures; 1 Residential Ren. 2 Residential Additions 2 Comm. 4 Use & Occupancy, 4 fire inspections and 2 Zoning Hearings for September
Mr. Troutman from 1701 Red Bud located in Spinnerstown Crossing came before the board looking for a waiver of rear buffer yard for a pool placement in his rear yard. Terry Clemons explained what a buffer is reference section 520 c.6 of SALDO. Mansfield motion to allow pool within buffer but no closer than 15Õ to property line 2nd by Strunk.
Managers Report
The Weiss Road bridge was inspected with minor recommendations and a longer term indication that we need to monitor the beams that have more costly implication. The report is available for review.
Nursery Road Bridge will be closed by Bucks County for repairs in the near future (date unspecified) for 3 to 4 months. Detours will use Upper Ridge and Trumbauersville Roads.
Resolution 2011-18 – C & M (Milford Pointe) Release #12
Strunk moved to approve the C & M Release #12 of $662,672.98 to Milford Township (remaining $626,686.80). Seconded by Mansfield and passed.
Resolution 2011-19 – Snider Act 537 Planning Module
Act 537 Snider property 2010 Upper Ridge Road has been reviewed to be forwarded to DEP after board approval. Moved by Mansfield, seconded by Strunk to approve Snider 537 and passed..

Minutes of September 27, 2011 Work Session
Call to Order: Meeting was called to Order by Chairman at 5:30 p.m.

Thomas T Butts: representative from Keystone Collections Group met with board to discuss issues pertaining to the transition to Keystone Collections Group.
Concern was expressed about how it will be possible to verify that the revenue we are receiving is correct and that withheld taxes are not sent to other jurisdictions. Tom indicated that if our data base is accurate then the correct amount would be billed and received. Vey asked that we work out procedures for Keystone to receive Use and Occupancy information to update lists and Milford receive the database (without confidential information) to verify accuracy.
Discussion on collection fee invoices is that we would pay the invoices separate rather than being deducted from the revenue.
Mr. Butts agreed that collection of our delinquent taxes could be handled from their office, they have opened a new in office in Warrington.
Milford-Trumbauersville Sewer Authority: Joe Valentine, MTASA Board member, reported that there has been no development activity. There was discussion regarding the Gambone property located behind the WaWa. The developer still needs to provide plans showing sewer for the full frontage of property on Weiss Road and need an Act 537 – postcard mailer.
He stated that the MTASA Board would consider selling the pond on the AuthorityÕs property to the township, discussion was on whether parking could be shared and if the Authority would want to put a fence around the AuthorityÕs building, there will be further discussion at the MTASA next meeting. Vey was directed to have a zoning compliant sketch plan prepared for discussion.

Public Works Report:
Most of the month the Public Works department worked at the C&M development. Road improvements along Starr Road and Rosenberger Road were finished. Work was started installing the walking trails along Starr Road and Rosenberger Road. Work was done cleaning up after storm damage.
Code Enforcement Report:
During September 2011, the following permits were issued: 4 Residential accessory structure; 2 Residential Renovations, 1 logging permit, 1 sign permit and 9 Use & Occupancy.
Township Manager:
(a) Resolution 2011-23 – Accepting Alimingo Drive, Katining Lane and Tamanend Drive as Public roads in the Milford Township subdivision know as Milford Pointe.
(b) Resolution 2011-24 – Accepting New Road, Milford Township constructed a portion of New Road which fronts or crosses 23-10-21,23-10-23 and 23-10-22-6 are accepted as a public road in the township.
(c) FEMA dropped off brochures for hurricane relief; the information has been posted on the web site.
Peg Carson:
Ms. Carson proposed a sign business in the building next to FaraccoÕs pizzeria and requested a waiver from formal land development approval. Her signs would be carved signs made of polyurethane not wood products. The existing building with no additional space and existing parking would be used. Delivery frequency would be approximately once every six weeks and would comply with all zoning requirements. Mansfield made a motion to waive land development; it would require a Use and Occupancy and will have to comply with all zoning regulations. 2nd by Charles Strunk
Public Comments: Robert Flack Mill Hill Road asked if something could be done about the intersection of Portzer and Old Bethlehem Pike there was another accident there, Jeff Vey will contact Penn Dot to see if something could be done with the intersection. Penn Dot is going to put in a roundabout but that project will be in the future.

Minutes of October 18, 2011 Regular Meeting
Supervisors Present: Robert B. Mansfield, Chairman; Charles Strunk, Vice-Chairman and Timothy Damiani, Supervisor, were excused.
Attendance: Marilyn Stecker, Assistant Manager Audience: 12.
Sgt. Eric Turk Commander of the State Police barracks in Dublin, PA attended the meeting to introduce himself. Robert Flack asked questions about coverage for Milford, Trumbauersville, & Richland Township and was informed that RichlandÕs coverage is usually at night since they have a staff for daytime, but the other areas are covered full time. Calls are prioritized and then answered. There has been a trend of break-ins lately with 17 burglaries in Milford and 2 groups taken into custody. Sgt. Turk recommended all to keep doors locked and use motion lights as a deterrent. Robert Mansfield commented that he is impressed with the response time he has seen.
Mrs. Jackson from 1645 Canary Road expressed that she is having conflicts with her neighbor and asked for assistance. Bob Mansfield advised he would discuss Code Enforcement issues with Jim Young. She thanked Bob and left the meeting.
Scott Hendricks stated it is time for the board to replace Tim Damiani who suffered a stroke. Bob Mansfield stated that the board does not have to power to remove another supervisor and the position is not vacant unless Tim resigns or there is court action. Tim still has a desire to return as a member and, though physically impaired, Tim has his mental capacities. Jim Walsh suggested that maybe it was time to increase the size of board from 3 to 5.
Chris Tray commented on the disc golf course erosion at some of the teeÕs. The slope is in need of vegetation to help with the problem and asked that the board reconsider removing the course. Nancy Gill shared her interest in having the course removed. Bob Mansfield said that the board would review the facts.

There is prep work involved, right of ways need to be acquired and poles would need relocation and closing of roads would need to be after school is out for summer recess.
The Road Department has been trying to overlay a mile of road each year. This year Sleepy Hollow ($120,000 - $140,000) was deferred by the C&M work necessitated by developer default and not projected at budget time.
Dave Winkler left the meeting at 5:55 p.m. and work focused on revenue projections and initial expense projections for the 2012 budget.

Minutes of November 1, 2011 Regular Meeting
Call to Order: Meeting was called to Order by Chairman at 7:00 p.m. at the Milford Township Municipal Building and opened with the Pledge of Allegiance to the U.S. Flag.
Supervisors Present: Robert B. Mansfield, Chairman; Charles Strunk, Vice-Chairman; Timothy Damiani, Supervisor, was excused.
Attendance: Jeff Vey Township Manager, Marilyn Stecker Assistant Manager, Dave Winkler Public Works Director Audience: 7.
Approval of Minutes of Previous Meeting: Mansfield made a motion to approve the Minutes of the September 27, 2011, October 4, 2011 & October 25, 2011 meetings. Motion was seconded by Strunk and passed.
Approval of Invoices for Payment: Having reviewed the invoices, Strunk made a motion to approve the invoices for payment. Motion was seconded by Mansfield and passed.

Public Works Report:
The public works department finished the New Road project.
We painted double yellow lines on Mill Hill Road.
We finished the retaining wall in front of 2000 Rosenberger Road and continued paving the walking trail along Rosenberger Road.
We had to cinder and plow one time this month and are still out cleaning up from our early snowstorm.
Code Enforcement Report:
During September 2011, the following permits were issued: 1 single-family dweling, 1 commercial renovation, 1 residential addition, 5 residential renovations, 1 residential demo-basement and 5 Use & Occupancy.
Township Manager:
(a) Resolution 2011-25 – Milford Township supports renewed funding of the Growing Greener Program
(b) Resolution 2011-26 – Emerald Hollow Phase 2 escrow Release #20 $29,707.65
Approval of Outside Contractor Bid - Mansfield made a motion to approve Ray Heffentrager, Inc. as low bidder. Motion was seconded by Strunk and passed.
Milford-Trumbauersville Area Sewer Authority Lake - Pete Andersen prepared sketch plans and forwarded them to MTASA for their consideration to subdivide off land including their lake for inclusion in Milford TownshipÕs open space system. We are now awaiting their comments.
West Swamp Church Lot Line Change – 2501 Allentown Road. This proposal would move the existing lot line from the center of the parsonage to create a lot that, while still undersized, would have conforming side yards. After considerable discussion of the zoning requirements of Section 800, it was determined that the proposal does not involve a change of use, an expansion or the creation of a new lot so no zoning hearing would be required. The proposal shows an area for a replacement sewage system. The supervisors determined that soil testing of this area would need to be done. This proposal will be on the agenda for the planning commission meeting for November.
Butler Valley Zoning Hearing Decision - 2150 Rosedale Road – The supervisors discussed the expansions allowed in the recent zoning hearing decision and directed the solicitor to appeal the expansion of the mulch operations into the fields in the front of property.
Public Comments: Bob Flack thanked Dave for the good job the road crew has done. Mary Flack asked who to call about trees threatening electric lines near their driveway and was directed to call PPL.
Preliminary Budget Preparation - The revisions to the preliminary budget draft from the work session were discussed. Particular attention was given to the potential decline of Earned Income Tax revenue attributable to the state-mandated change of collection procedures. The preliminary budget is anticipated to be ready for adoption at the November 15, 2011 meeting.

Tennis Court has a crack that needs to be repaired

Memorial lights are not operating
Ed would like the assistance of Public Works to help him with painting and replacement of Plexiglas cover of the relocated Steinsburg Memorial.
Barrel Run Trail is slated to start construction in 2011.
The Park Board reviewed the Open Space Stewardship Report prepared by the Natural Lands Trust and makes the following recommendation.

Managers Report
2011 Audit - Mansfield moved to appoint Styer Associates to audit the 2011 Financial Records and sign the engagement letter. Motion was seconded by Strunk and passed.
Authorization to Acquire Open Space - Mansfield made a motion to authorize preparation of an agreement of sale to acquire open space in the Finland area based on appraised valuation. Motion was seconded by Strunk and passed.
Milford Township Fire Company Fee Waiver Request - Milford Township Volunteer Fire Company asked that the fee for the U&O be waived where an old tenant is being replaced by Wa-Wa maintenance in the old bays. Mansfield made a motion to waive fees, seconded by Strunk and passed.
2012 Preliminary Budget
Mansfield made a motion to approve the 2011 Preliminary Budget and to advertise for its adoption as the final budget, seconded by Strunk and passed.
The Budget is available for public inspection during normal business hours.
Public Comments: Bob Flack informed that the motion lights at the recycling center were not working.
