Minutes of February 23, 2011 Regular Meeting

 

Call to Order: Acting Chairman, Ed Bolton, called Meeting to Order at 7:30 p.m.

 

Members Present: Carson Schneck, Ed Bolton, Jack Merritt, Sue Edwards. Fran Murray was excused

 

Reorganization:

 

Sue Edwards moved to elect Fran Murray Chairman, Jack Merritt seconded with unanimous vote in favor.

Sue Edwards moved to elect Ed Bolton Vice Chairman, Jack Merritt seconded with unanimous vote in favor.

Jack Merritt moved to elect Sue Edwards Secretary, Carson Schneck seconded with unanimous vote in favor.

Reviews

 

                  Bimes – Minor Subdivision – Freier and Hillcrest Roads - TMP 23-21-120-1

                                   

                  The Bucks County Planning Commission review dated January 13, 2011, the Andersen Engineering review dated December 27, 2010 and the Zoning Hearing Order dated November 9, 2010 were reviewed.

 

Bob Irick, representing the Bimes as their engineer, asked that the county planning recommendation to share access not be imposed in that Freier Road is a low volume road and a shared driveway would require the garage on lot 2 to be on the left imposing design limitation that are probably not necessary. There was general concurrance. Mr. Irick clarified that both lots are intended to be serviced with public sewer and lot 2 is intended to be serviced with public water, but the applicant is requesting that existing dwelling on lot 1 continue to be serviced by on-lot water.

 

                  Jack Merritt moved that the Planning Commission recommend preliminary/final plan approval including the requested waiver requests (involving curbs, sidewalks, cartway widening, the ÒExisting Resource and Site Analysis PlanÓ and connection of lot 1 to public water) subject to the condition that a note be placed on the plan that a grading plan and an erosion and sedimentation control plan is required at the time of application for a building permit. Seconded by Schneck and passed unanimously.

 

                  Milford Village Lot H – Minor Subdivision – John Fries Hwy – TMP 23-15-99

                                   

                  The Bucks County Planning Commission review dated January 20, 2011, the Andersen Engineering review dated January 18, 2011 and the Quakertown Area Planning Committee review dated February 11, 2011 were reviewed.

 

Steve Pany, representing the applicant as their engineer, explained that this proposed subdivision is being pursued to satisfy requirements of the U.S. Department of Housing and Urban Development (HUD). HUD provided financing for the nursing home on the existing lot that is larger than needed for the nursing home. This subdivision would reduce the size of the nursing home lot and allow the remainder to be developed as proposed in the approved Milford Village Center plan.

 

There was considerable discussion regarding the impervious surface coverage and the necessity to have this land legally bound to the Arterial Mixed Use Master Plan. Otherwise this site would violate zoning limitations as an independent site if obligations (such as open space and additional pervious area) are not imposed on the remainder of the Milford Village Center. The applicant also requested that the existing driveway be allowed for continued use as a private street without being required to meet public road standards of SALDO sec. 503 i until subsequent development.

 

                  Susan Edwards moved that the Planning Commission recommend preliminary/final plan approval subject to the condition that a Declaration of Covenants and Restrictions, satisfactory to the Township Solicitor, be simultaneously recorded with the plan that binds the resulting lots of this subdivision to the Arterial Mixed Use Master Plan of the Milford Village Center requiring development of the entire site to be constrained by the regulations of the zoning ordinance. Additionally, the Planning Commission recommends that the existing driveway to the nursing home be allowed for continued use without being required to meet the public road standards of SALDO sec. 503i until there is further land development. Seconded by Merritt and passed unanimously.

 

                  Richards – Minor Subdivision – Brick Tavern Road

                                   

                                    The Bucks County Planning Commission review dated January 18, 2011 and the Andersen Engineering review were reviewed.

 

Deane Riniker, representing the applicant as their engineer, stated he will change the selection of proposed tree species to conform to Bucks County Planning recommendations. He referenced the zoning questions raised by the Andersen Engineering review involving definitions related to the agricultural uses on the property and how they affect the residential density. He informed the Planning Commission that he, the RichardÕs attorney, Kevin Wolfe and Jeff Vey were meeting on February 24th to try to resolve zoning issues and asked that the Richards plan be tabled.

 

                  Jack Merritt moved that the Richards plan be tabled. Seconded by Schneck and passed unanimously.

 

                  Milford Convenience, LP – Minor Subdivision – Weiss Rd & Rt 663 – 23-10-101 & 100-1

                                   

                  The Bucks County Planning Commission review dated December 7, 2010 and the Andersen Engineering review dated January 2, 2011 were reviewed.

 

The applicant stated that this proposal is a lot line change intended to make lot line more regular and to reduce the size of the residential lot with an existing dwelling that will be sold. The current lot configuration has a sixteen (16) ft strip connecting two larger area as part of one parcel and an appendage creating an ÒLÓ shape for the other parcel. This lot line change would result in two lots that are more rectangular in shape.

 

There was discussion regarding the PC-Commercial zoning district line and how it splits one parcel due to the current irregular parcel shape. The applicant would like the zoning line to be redrawn and the Planning Commission sees merit in changing the boundary. But all agreed that the current proposal is unaffected by the zoning district line.

 

                  Carson Schneck moved that the Planning Commission recommend preliminary/final plan approval subject to the condition that the right-of-way of Weiss Road be dedicated to the ultimate right-of-way. Seconded by Merritt and passed unanimously.

Minutes of March 30, 2011 Regular Meeting

 

Call to Order: the Chairman called Meeting to Order at 7:30 p.m. at the Milford Township Municipal Building.

 

Members Present: Fran Murray, Chairman; Carson Schneck, Ed Bolton, Sue Edwards, Jack Merritt was excused

 

Approval of Minutes of February 23, 2011 - were approved with one minor change page 2 Richards – Minor subdivision address shows Mill Pond Road should read Brick Tavern Road

Reviews

 

                  Richards – Minor Subdivision – Brick Tavern Road – TMP 23-10-100

                                   

                  Andersen Engineering review letter of March 15, 2011 and the Bucks County Planning Commission review of March 23, 2011 were reviewed.

                 

                  It was discussed that the greenhouses were legally non-conforming uses and that the proposed lot is for a single family use B-1.

 

                  Deane Riniker, the applicantÕs engineer, asked that waivers be granted for road widening, sidewalks, street lights, tree protection zone, surrounding features plans and plan sheet size.

 

                  Carson Schneck moved that final plan approval be recommended and waivers be granted on the condition that the right-of-way be dedicated, a conservation easement be granted for resource protected land, and public improvements be provided as required by the supervisors. Seconded by Sue Edwards and passed unanimously.

 

Special Exceptions

 

                  Price – 1730 Carvers Hill Road – TMP 23-07-050-006

 

                                    This application proposes a 360 sq. ft. addition. The application is a request for a special exception under section 804 to allow an addition extending a non-conforming side yard setback of 15Õ where a 30Õ set back is required.

                                   

                  Carson Schneck moved that the Planning Commission recommend the Zoning Hearing Board approve the applicantÕs request. Seconded by Susan Edwards and passed unanimously.

 

                  Souder – 2204 Spinnerstown Road TMP – 23-003-005

 

                                    This application is a request for a special exception under sections 802 & 404.H3 to allow the continuation of a non-conforming accessory apartment. Which is in the VC-2 Zoning District.

 

                  Motion by Carson Schneck, second by Fran Murray with unanimous vote to recommend approval on the condition public water is required or a waiver is given from the Water Authority. Proper documentation that public sewer services both units.

 

                  Stevens – 2360 Hillcrest Road Tmp 23-12-026 this application is a request for a special exception under sections 404.H.1b to allow a hair salon as a home occupation.

                  Carson Schneck moved that the Planning Commission recommend the Zoning Hearing Board approve the applicantÕs request. Seconded by Edwin Bolton and passed unanimously.

 

                  Petro – (Snider Owner) 2010 Upper Ridge Road Tmp 23-20-113

 

                  This application proposes a 650 sq. ft. accessory apartment to be constructed onto the rear of a non-conforming garage. The application is a request for a special exception under section 804 with a proposed side yard set back of 9Õ where a 30Õ set back is required.

 

                  Carson Schneck moved that the Planning Commission recommend the Zoning Hearing Board approve the applicantsÕ request. Seconded by Susan Edwards and passed unanimously.
